TERMS AND CONDITIONS OF THE ONLINE STORE WWW.FLAMENCERAMICS.PL<\/strong><\/p>

\u00a7 1 Preliminary Provisions<\/strong><\/p>

  1. The Flamen Ceramics online store, available at www.flamenceramics.pl, is operated by Marek Marczak, conducting business activity registered in the Central Register and Information on Economic Activity (CEIDG), Tax Identification Number (NIP): 5882474753, REGON: 520471122, ul. R\u00f3\u017cana 11, 84-240 Reda, Poland.<\/li>\n\n
  2. These Regulations define the rules for using the Store and the procedure for concluding Sales Agreements at a distance.<\/li><\/ol>

    \u00a7 2 Definitions<\/strong><\/p>

    1. **Seller** \u2013 Marek Marczak, an entrepreneur registered in the Central Register and Information on Economic Activity (CEIDG) at ul. R\u00f3\u017cana 11, 84-240 Reda, Poland, Tax Identification Number (NIP): 5882474753.<\/li>\n\n
    2. **Store** \u2013 the online store operated under the Flamen Ceramics brand.<\/li>\n\n
    3. **Consumer** \u2013 a natural person entering into a contract with the Seller that is not directly related to their business or professional activity.<\/li>\n\n
    4. **Entrepreneur with Consumer Rights** \u2013 a natural person entering into a contract directly related to their business activity, when it follows from the content of this contract that it does not have a professional nature for this person.<\/li>\n\n
    5. **Customer** \u2013 any entity making purchases in the Store.<\/li>\n\n
    6. **Product** \u2013 a movable item available in the Store.<\/li><\/ol>

      \u00a7 3 Prices and Currencies<\/strong><\/p>

      1. Prices in the Store are gross prices.<\/li>\n\n
      2. The Store uses an automatic payment currency matching system based on the Customer's location (IP address). The available currencies are Polish Zloty (PLN) for orders from the territory of Poland and Euro (EUR) for orders from other European Union countries.<\/li>\n\n
      3. The Store does not provide an option for manual currency selection by the Customer.<\/li>\n\n
      4. For payments in Euro, the final cost may depend on the exchange rate applied by the Customer's bank or payment provider.<\/li><\/ol>

        \u00a7 4 Order Placement<\/strong><\/p>

        1. Browsing and ordering do not require account registration (guest checkout).<\/li>\n\n
        2. The Customer adds a Product to the cart and fills out the order form.<\/li>\n\n
        3. Clicking the \"Buy and Pay\" button constitutes a binding offer to purchase with an obligation to pay.<\/li><\/ol>

          \u00a7 5 Delivery and Payments<\/strong><\/p>

          1. **Delivery** \u2013 InPost Parcel Lockers (Poland), courier delivery (Poland and the EU).<\/li>\n\n
          2. Payments: a) Traditional bank transfer to the Seller's bank account. b)\u00a0Online payments via the AutoPay service. The entity providing online payment services is AutoPay S.A.<\/strong>\u00a0c)\u00a0Payment cards: Visa, Visa Electron, Mastercard, MasterCard Electronic, Maestro.<\/strong>\u00a0d) PayPal payment. e) Cash on delivery (selected regions).<\/li>\n\n
          3. If the Customer chooses payment by bank transfer, electronic payment or payment card, the order processing time is counted from the date of crediting the Seller's bank account or settlement account (the moment of obtaining positive payment authorization).<\/strong><\/li>\n\n
          4. Payment deadline: In the case of prepayment, the Customer is obligated to pay within 3 business days. In the event of non-payment, the Seller will send an additional email reminder setting an additional deadline. After this deadline has passed, the Seller has the right to withdraw from the Sales Agreement.<\/li><\/ol>

            \u00a7 6 Right of Withdrawal<\/strong><\/p>

            1. The Consumer and the Entrepreneur with Consumer rights have the right to withdraw from the contract within 14 days without giving any reason.<\/li>\n\n
            2. The period starts from the day the Customer takes possession of the Product.<\/li>\n\n
            3. Withdrawal notice: kontakt@flamenceramics.pl.<\/li>\n\n
            4. If there is a need to refund funds for a transaction made by the customer with a payment card, the seller will make a refund to the bank account assigned to the Ordering Party's payment card.<\/strong><\/li>\n\n
            5. Refunds will be made within 14 days of receipt of the return. The customer bears the direct cost of returning the goods.<\/li>\n\n
            6. The right to withdraw does not apply to custom-made Products.<\/li><\/ol>

              \u00a7 7 Complaints (Lack of Conformity)<\/strong><\/p>

              1. The Seller is liable for the lack of conformity of the goods with the contract under the Consumer Rights Act.<\/li>\n\n
              2. The Customer may demand repair or replacement. Price reduction or withdrawal is possible only in cases specified by law.<\/li>\n\n
              3. Complaints: kontakt@flamenceramics.pl. Response time: 14 days.<\/li><\/ol>

                \u00a7 8 Technical requirements and cookies<\/strong><\/p>

                1. To use the Store, you must have: a) a device with Internet access, b) a web browser that supports Cookies and JavaScript, c) an active e-mail account.<\/li>\n\n
                2. The store uses cookies to ensure the proper functioning of the shopping cart mechanism and payment processes. Details are provided in the Privacy Policy.<\/li><\/ol>

                  \u00a7 9 Final provisions<\/strong><\/p>

                  Disputes may be resolved via the ODR platform: http:\/\/ec.europa.eu\/consumers\/odr\/<\/a>.<\/p>

                  The applicable law is Polish law, but the Consumer does not lose protection under the mandatory laws of their country of residence.<\/p>
